This website is operated by OmniStash. Throughout the site, the terms “we”, “us” and “our” refer to OmniStash. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink, including our Privacy Policy and Refund Policy.
Sending a request through this website is not a purchase and does not create an order. We reply by email with the price, options and shipping details, and a purchase only takes place when you confirm and pay by PayPal. No payment is taken through this website.
Section 1 — International shipping, customs, and duties
- Third-party fulfillment: You acknowledge and agree that OmniStash products are sourced internationally and shipped directly from third-party fulfillment centers and suppliers located overseas (including, but not limited to, China).
- Delivery timelines: Shipping times are estimates only. OmniStash is not liable for transit delays caused by customs processing, postal strikes, or international shipping bottlenecks.
- Importer of record: When ordering from OmniStash, the recipient is the importer of record and must comply with all laws and regulations of the destination country.
- Customs duties and taxes: Orders shipped outside of Uruguay may be subject to import taxes, customs duties, and fees levied by the destination country. All such additional charges for customs clearance are the sole responsibility of the customer. OmniStash has no control over these charges and cannot predict what they may be.
Section 2 — Accuracy of product information and pricing
- Supplier data: Product descriptions, specifications, imagery, and sizing charts are provided directly by international suppliers. OmniStash does not warrant that product descriptions or other content are 100% accurate, complete, reliable, or error-free.
- Color variance: Colors of products may vary slightly due to digital photography and monitor configurations.
- Pricing fluctuations: Prices are quoted by email at the time of your request and may change without notice. If a supplier changes their pricing unexpectedly before you have paid, OmniStash reserves the right to re-quote or cancel the affected order.
Section 3 — Order modifications and cancellations
- Right to refuse service: OmniStash reserves the right to refuse or cancel any order you place with us for any reason.
- Quantity limits: We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
- Supplier stock issues: Because inventory relies on third-party suppliers, an item may become unavailable after your purchase. In this event, OmniStash will cancel the order and issue a full refund immediately.
Section 4 — Returns, refunds, and international shipping fees
- Refund policy: Our standard refund policy lasts 30 days from the date of delivery. If 30 days have gone by since your delivery, we cannot offer you a refund or exchange. Full details are in our Refund Policy.
- International return logistics: To be eligible for a return, your item must be unused and in the same condition that you received it. You acknowledge that you may be required to return the item directly to the international supplier's warehouse (e.g., in China).
- Return shipping costs: The customer is entirely responsible for paying all international shipping costs for returning an item. Shipping costs are non-refundable.
Section 5 — Limitation of liability
- No warranties: We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free.
- Damages cap: In no case shall OmniStash, our directors, officers, employees, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind arising from your use of any of the products procured using the service, except where such liability cannot be limited by law.
Section 6 — Governing law and jurisdiction
- Uruguayan jurisdiction: These Terms of Service and any separate agreements whereby OmniStash provides you Services shall be governed by and construed in accordance with the laws of Uruguay.
- Dispute resolution: Any dispute arising from or relating to the use of this website or purchases made herein shall be subject to the exclusive jurisdiction of the competent courts located in Montevideo, Uruguay.
